{"id":824,"date":"2026-07-16T16:12:39","date_gmt":"2026-07-16T14:12:39","guid":{"rendered":"https:\/\/distracted-yalow.46-202-175-195.plesk.page\/?page_id=824"},"modified":"2026-07-17T10:22:59","modified_gmt":"2026-07-17T08:22:59","slug":"general-rental-terms-and-conditions","status":"publish","type":"page","link":"https:\/\/distracted-yalow.46-202-175-195.plesk.page\/en\/general-rental-terms-and-conditions\/","title":{"rendered":"General Rental Terms and Conditions"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>General Terms and Conditions of Drago Broadcast Services, S.L.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rates and quotations shall be valid for five (5) days, except in the event of typographical errors, and their issue does not constitute a reservation of the equipment. The quotation must be accepted in writing by the Client before the equipment is delivered or, where applicable, before the services begin. Such acceptance shall be binding on the Client and shall apply on a supplementary and subsidiary basis to the specific rental agreement into which it is incorporated. By accepting the quotation, the Client shall be deemed to have read, understood and accepted these General Terms and Conditions. If the stated period expires without written acceptance, Drago Broadcast Services, S.L. (hereinafter, \u201cDRAGO\u201d) may change the prices without prior notice. Any change not included in the original quotation must be approved through a new quotation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payment must be made in full and in advance for the total invoice amount, including taxes, before the equipment is collected or shipped. Payment may be made by bank transfer, cash or credit\/debit card, unless the parties expressly agree to another payment method.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DRAGO owns the equipment or holds valid title authorizing it to rent the equipment. The Client must provide DRAGO with all documentation required in connection with this quotation and sign the corresponding rental agreement before the equipment is delivered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rental period shall begin when the Client collects the equipment or, where applicable, when it is shipped to the Client. Delivery shall take place at DRAGO\u2019s premises. If the Client requests delivery to another location, the Client shall bear all transport costs and shall be responsible for the equipment during shipment and receipt, releasing DRAGO from any liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The equipment must be returned to DRAGO\u2019s premises at the address stated in the agreement or, if no address is stated, to its facilities in Tres Cantos, no later than 12:00 noon on the day the rental period specified in the quotation ends. A return delay of up to twenty-four (24) hours shall result in a penalty equal to 80% of the rental charge for each day of delay. If the delay exceeds 24 hours and is no more than 72 hours, an additional charge equal to 100% of the rental charge shall apply for each further day of delay. If the delay exceeds 72 hours, DRAGO shall take any appropriate legal action, including claims for loss and damages. Failure to return the equipment may be considered a criminal offence and may therefore be prosecuted in accordance with applicable law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client may cancel delivery of the equipment before the agreed rental period begins. If the cancellation is made at least 24 hours before the delivery or collection date, a charge equal to 40% of the agreed daily rate shall apply. If the cancellation is made less than 24 hours before the delivery or collection date, the Client shall pay 75% of the agreed daily rate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The equipment is delivered in full working order and in good condition. The Client is entitled to inspect and test the equipment before collection. Once the equipment has been delivered or shipped, DRAGO shall not be liable for any faults or defects that may arise in the rented equipment. DRAGO supplies certain items with disposable cells and\/or batteries solely for testing purposes. The Client is responsible for obtaining the cells and\/or batteries required for correct and continuous use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client undertakes to use the equipment diligently and correctly and to ensure that it is handled only by suitably qualified personnel. The Client must return the equipment in full working order and in good condition and shall be responsible for its care and maintenance as if it were the Client\u2019s own property. The Client is expressly prohibited from dismantling the equipment or allowing third parties to dismantle it, or from selling, assigning, transferring or otherwise disposing of the equipment or any of its accessories. Any breach may give rise to the corresponding legal liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DRAGO shall not be liable for any loss or damage suffered by the Client or any third party in connection with the rented equipment, regardless of the cause. In particular, DRAGO shall not be liable for damage resulting from misuse, technical failures occurring after delivery of the equipment or any consequences arising from the use of the equipment in the Client\u2019s production.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client must hold an insurance policy covering the replacement value of the rented equipment. The Client shall be responsible for any damage, theft, robbery, accident or loss involving the equipment, including replacement at market value and any costs arising from the equipment being unavailable. At DRAGO\u2019s request, the Client must provide a copy of the insurance policy before collecting the equipment. If the Client does not provide the policy, DRAGO may refuse to release the equipment without incurring any liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Alternatively, following an express written request, the Client may be covered under DRAGO\u2019s equipment insurance, subject to an additional charge equal to 8% of the rental value. This insurance is subject to the general terms of DRAGO\u2019s policy. For the insurance to apply, the Client must keep the equipment under its control at all times and ensure its correct use and maintenance. The policy carries an excess of \u20ac2,500 per incident and per item of equipment. The insurance does not cover equipment downtime resulting from repair or replacement; all such costs shall be borne by the Client. The following are expressly excluded from cover: (i) robbery, theft, unlawful taking or fraud; (ii) loss of equipment; (iii) unauthorized technical intervention on the equipment; (iv) negligence in the handling or safekeeping of the equipment; (v) damage caused by natural disasters, war, terrorist attacks or civil unrest; (vi) high-risk shoots, including but not limited to filming in or on water, aerial filming using drones or similar devices, filming from motor vehicles or adventure sports; and (vii) damage to camera sensors, cables and filters, for which the Client shall pay 100% of the replacement value. In all cases, the Client shall be responsible for any damage, loss or expense not covered by the insurance policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regardless of the insurance held by the Client, DRAGO\u2019s express written authorization is required before the equipment may be used for high-risk shoots, including filming from vehicles, vessels or aircraft. In the event of theft, loss or unlawful taking of the equipment, the Client must continue to pay the daily rate for the affected equipment until it is replaced. Replacement shall be charged at 100% of its market value.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DRAGO\u2019s insurance covers the whole of Spain, including the Balearic and Canary Islands, but does not cover shoots outside Spain. Rented equipment may not be taken outside Spain without DRAGO\u2019s express written authorization. DRAGO may require additional documents and guarantees before granting authorization. If the equipment is to be used outside Spain, the Client must request prior authorization and provide all required documentation before collection, including but not limited to insurance, an ATA Carnet and any other documents required for customs transit. The Client shall bear all costs associated with transport, insurance, documentation and any costs arising from customs transit or the equipment being held by customs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client must notify DRAGO of any incident affecting the rented equipment, including but not limited to breakage, robbery, theft or fire, within twelve (12) hours of becoming aware of the incident. The Client must also report the incident to the relevant authorities where required. If the damaged equipment is an indivisible item or the manufacturer does not supply separate replacement parts, the Client shall bear the full replacement cost.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DRAGO shall not accept claims regarding damage to or malfunction of the equipment after it has been returned by the Client. Any claim must be made in writing, with acknowledgement of receipt, at the time the issue occurs. The Client shall bear the costs arising from any loss, damage or breakdown occurring during the rental period. DRAGO shall assess such issues as soon as possible but cannot guarantee an immediate assessment when the equipment is returned, as certain items may require inspection by specialist Technical Services, which may delay confirmation of the final cost. The Client agrees that any issues identified by DRAGO shall be binding, whether or not the Client was present when the returned equipment was inspected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For feature films, short films, documentaries and any other audiovisual project that includes credits, the Client undertakes to credit DRAGO as the technical equipment supplier. The font size must be equal to or larger than that used for Lighting, Post-Production or other relevant technical suppliers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DRAGO reserves the right to terminate the agreement immediately and without prior notice, retaining all amounts received and without prejudice to any further legal action it may take, in any of the following circumstances: (a) the Client breaches any condition set out in this agreement; (b) any statement or document provided by the Client is false or inaccurate; (c) the Client fails to pay, or pays late, any amount due within the stated deadlines; or (d) the Client becomes insolvent, including through attachment, bankruptcy or court-ordered liquidation. In the latter case, the Client must notify DRAGO promptly in writing and provide supporting documentation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For any dispute arising from the performance, interpretation or enforcement of these terms, the parties expressly waive any other jurisdiction that may apply and submit exclusively to the jurisdiction of the courts of Madrid.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>General Terms and Conditions of Drago Broadcast Services, S.L.
